How Does Selling a Home During a Divorce Work, Step by Step?
How does selling a home during a divorce work?
It follows the same path as any sale: get the home ready, price it, list it, review offers, go through escrow, and close. What changes is who is involved and how the decisions get made. There are usually more people in the conversation: both owners, sometimes attorneys, sometimes a mediator.
Tanja Odzak is an East Bay Realtor with eXp Realty and holds the Real Estate Collaboration Specialist, Divorce (RCS-D) and Real Estate Divorce Specialist (CREDS) certifications. This guide explains the selling side in plain words. For the bigger picture, see selling a house during a divorce in the East Bay.
Who does what?
A Realtor handles the selling side: the preparation, the marketing, the offers, and the contract dates. Your attorney and mediator handle the legal side. A good Realtor works alongside them and never in place of them.
Questions about how proceeds are divided, what a sale means for support or taxes, or your legal rights belong with your own attorney and tax professional. That line matters, and it is the first thing worth understanding.
What makes the sale go more smoothly?
- Decide early who handles day-to-day decisions. Things like showings and responding to offers need a clear answer before the home is listed.
- Share the timeline your attorney or mediator is working with. The sale can then be planned around it, instead of colliding with it.
- Keep the conversation about the home. What it needs, what it is worth, and what buyers will see.
Do both owners have to be in the same room?
No. I can speak with each owner separately, by phone or video, and what you tell me privately stays private. We can also meet by video call with both of you on at the same time. Sometimes that is the better choice, because you both hear the same information at the same moment.
What are the steps, in order?
- Talk it through. We discuss the home, the people involved, and the dates that matter.
- Agree on how decisions get made. Who is the main contact, and how offers are shared with both owners.
- Get the home ready. Whether it will be vacant while listed shapes this step; see vacant or lived in while it is listed.
- Price it and list it. Based on recent sales of comparable homes nearby.
- Review offers, then escrow and closing. Offers go to both owners at once.

Frequently Asked Questions
Is selling a home in a divorce different from any other sale?
The steps are the same: preparation, pricing, listing, offers, escrow and closing. What differs is that two owners, and often attorneys or a mediator, are part of the decisions.
Does a Realtor give legal advice in a divorce?
No. A Realtor explains the selling process. How proceeds are divided, support, taxes, and legal rights belong with your own attorney and tax professional.
Do both of us need to meet with the Realtor together?
No. A Realtor can speak with each owner separately, or with both at once on a video call, whichever works better for you.
