Should the Home Be Vacant While It Is Listed During a Divorce?
Should the home be vacant while it is on the market?
In my market, the home is more often vacant. The owners have moved out, and the home is prepared and shown empty or staged. That keeps preparation and showings simple, and it is usually the easier path.
Tanja Odzak is an East Bay Realtor with eXp Realty. The first question she asks in any divorce sale is the same: will the home be vacant while it is listed, or does someone need to live in it until it sells?
Can someone stay in the home while it is listed?
Yes. It is possible, and I can work with it. But coordinating your life around showings while you are still living in the house can be very difficult, and it is worth being honest about that before you decide.
What should you do if you are staying?
My advice is always the same: declutter, depersonalize, and deep clean.
- Remove anything valuable from the home, along with all medications and any important papers.
- Take down photos and remove anything valuable or sentimental.
- Make it neutral. The home should show as a clean, neutral space, and your belongings should be safe somewhere else.
How do showings work when someone lives there?
We decide on a showing schedule and arrange the times beforehand, so nothing is a surprise. We also talk about whether there are certain days that work for open showings and drop-in visits, and which days do not.
What if you have not decided yet?
That is fine. Tell me where things stand and we will plan around it. If the home needs work before it is listed, we plan it backward from the day it goes on the market.
And if it is a hard time to be in the house, say so. It can change how we schedule the work and the showings. This is general information about the selling process, not legal, tax, or lending advice. Tanja is a Realtor, not an attorney, mediator, or accountant.
