Who Decides Which Agent Sells the Home in a Divorce?
Who chooses the agent when a home is sold in a divorce?
Usually the owners agree on it, sometimes with their attorneys or a mediator. In some cases it is decided by the court. A Realtor cannot tell you who should decide, and neither can this article. Your attorney can.
Tanja Odzak, an East Bay Realtor with eXp Realty, can tell you how the selling side works once she is your Realtor, and that is what this guide covers.
Will both owners get the same information?
A sale goes best when both owners trust the person running it. My job is to make that easy: to stay calm and fair, and to keep the focus on the home rather than on the history between you.
As your agent I work for the sale of the home, and I share the same information with both owners, so nobody is surprised.
Who decides on price and offers?
That depends on your situation and on what your attorneys or mediator have agreed. What I can do is help you decide how decisions will get made before the home is listed, so you are not working it out under the pressure of an offer.
Four questions are worth answering early:
- Who is the main contact for showings and scheduling?
- How will offers be shared with both owners?
- How quickly does each of you need to respond?
- Who signs, and where does your attorney need to be involved?
How do you keep everyone on the same page?
Write the answers down, even in a simple email. A short written agreement on who does what saves a lot of friction later, and it is easy to share with your attorney or mediator.
The same rule applies to the calendar. If your attorney or mediator has dates they need to meet, share them early, and I can tell you how a sale could fit around them.
What if you are not sure yet?
That is a normal place to be. A free 30-minute call is a low-pressure way to see how this could work for your situation. It is optional and private, and I am glad to speak with each owner separately. This is general information about the selling process, not legal, tax, or lending advice. Tanja is a Realtor, not an attorney, mediator, or accountant.
